1. Presentation

EZGather is desktop automation software that automates certain actions in the Dofus Unity video game. EZGather is an automation tool designed to facilitate your farming and gathering sessions by combining AI-powered vision, intelligent navigation, and advanced scheduling.

2. Object

These Terms of Service (hereinafter 'Terms') govern the use of EZGather software and associated services. They define the rights and obligations of the user and the publisher.

3. Warning

IMPORTANT WARNING :

EZGather is provided for informational purposes and for testing and accessibility purposes. Use of this software on third-party game servers, including Dofus and Ankama servers, is entirely at your own risk.

Important Risks :

  • ●EZGather does not guarantee compatibility with the Terms of Service of Dofus/Ankama or any other third-party game
  • ●Use of the software may result in serious sanctions on your account
  • ●Permanent ban, account suspension, or loss of your in-game items and characters
  • ●EZGather cannot be held responsible for such sanctions

The user assumes full responsibility for using the software and the consequences that may result.

4. Access Conditions

Use of EZGather is subject to the following conditions :

  • ●You must have an active and valid EZGather account
  • ●You must be at least 18 years old, or have parental or guardian authorization if you are a minor
  • ●Use of the software is strictly personal and non-commercial
  • ●You may only use EZGather for your own account and at your own risk

5. Authorized Use

You agree to use EZGather in compliance with applicable law and these Terms.

It is prohibited to :

  • ●Use the software for fraudulent or illegal purposes
  • ●Perform reverse engineering, decompilation, or attempt to discover the source code or algorithms of the software
  • ●Resell, redistribute, or make the software or account available to third parties
  • ●Bypass or attempt to bypass the security, control, or verification measures of the software

6. Liabilities

The user is solely responsible for the use he/she makes of the software and the consequences that may result.

EZGather cannot be held responsible for :

  • ●Sanctions imposed by third-party game publishers (bans, suspensions, loss of items)
  • ●Direct or indirect damages caused by the use of the software
  • ●Loss of data or in-game characters
  • ●Interruption or unavailability of the service
  • ●Any harm resulting from the use or inability to use the software

7. Intellectual Property

The software EZGather, its source code, its user interface, its documentation, its algorithms and any material created or developed by EZGather remain the exclusive property of EZGather.

  • ●The license granted does not confer any intellectual property rights on the software
  • ●You have no right to modify, adapt, translate, or create derivative works based on the software

8. Personal Data

Personal data collected by EZGather (email address, hashed hardware identifier, anonymized usage statistics) are stored securely.

Payments :

  • ●Payments are processed via Stripe, a certified payment provider
  • ●EZGather does not store your banking data (card numbers, security codes, IBAN)
  • ●Stripe manages the entire payment process under its own privacy policy

9. Modification of Terms

EZGather reserves the right to modify these Terms at any time and without notice.

  • ●Modifications will take effect immediately after publication
  • ●Any significant modification will be communicated to users via the application or email
  • ●Continued use of the software after a modification constitutes acceptance of the new terms

10. Duration and Termination

These Terms apply as long as you use EZGather software.

Termination :

  • ●You can terminate your account at any time from your dashboard
  • ●EZGather reserves the right to suspend or terminate any account in violation of these Terms, without notice or compensation
  • ●In case of termination for violation, no refund will be granted

11. Non-Affiliation Clause

EZGather is not affiliated, endorsed, or approved by any game publisher, including Ankama Games, creator of Dofus.

  • ●EZGather is independently developed software
  • ●Dofus and all related elements are trademarks of Ankama Games
  • ●EZGather has no commercial or legal relationship with these entities

12. User Responsibility Clause

The user assumes full responsibility for verifying the compatibility of EZGather use with the Terms of Service of third-party platforms on which the software is used.

The user acknowledges :

  • ●Being informed of potential risks associated with the use of automation software on these platforms
  • ●Accepting these risks knowingly

13. Indemnification Clause

The user agrees to indemnify and hold harmless EZGather, its officers, employees and representatives from any claim, action, demand, loss, damage, liability or costs (including legal fees) resulting from :

  • ●The use of the software
  • ●Violation of these Terms
  • ●Infringement of the rights of a third party
  • ●Violation of applicable law

14. No Warranty Clause

EZGather is provided "as is", without any warranty of any kind.

EZGather does not warrant** :

  • ●That the software will operate without errors or interruptions
  • ●Compatibility with all operating systems or configurations
  • ●Continuous or uninterrupted availability of the service
  • ●The accuracy or reliability of the results produced by the software

You use the software at your own risk.

15. Declared Purpose of Software

EZGather is declared as automation software designed for purposes of automation, testing, and accessibility.

The software is intended to :

  • ●Facilitate certain repetitive tasks
  • ●Improve accessibility for users with specific needs

16. International Jurisdiction

The user acknowledges that applicable laws vary by jurisdiction.

The user commits to complying with all applicable local legislation in their country or region regarding :

  • ●Use of automation software
  • ●Access to video games and online services
  • ●Data protection and privacy
  • ●Tax and commercial obligations

17. Automatic Deactivation / Force Majeure

EZGather reserves the right to automatically deactivate or suspend any account in case of :

  • ●Detection of violation of these Terms
  • ●Fraud
  • ●Abuse

EZGather cannot be held responsible for service interruptions caused by force majeure events (natural disasters, computer failures, cyberattacks, etc.).

18. No Encouragement of Misuse Clause

EZGather does not facilitate, encourage, or incite the user to :

  • ●Violate the Terms of Service of third parties
  • ●Commit fraud
  • ●Violate the law

EZGather provides the software for informational and educational purposes. The user is solely responsible for their actions and the legality of their use.

19. Contract Language

These Terms are written in French, English, and Spanish.

In case of conflict or ambiguity of interpretation, the French version prevails.

20. Applicable Law and Jurisdiction

These Terms are subject to French law and the exclusive jurisdiction of the competent courts of the EZGather headquarters.

Any dispute relating to the interpretation, application, or performance of these Terms will be submitted to the courts of France.
